Welcome to the Q Bazaar NFT Marketplace!

This Terms of Service agreement (the "Agreement") governs your access and use of the Q Bazaar NFT Marketplace (the "Marketplace"). By using the Marketplace, you agree to be bound by this Agreement. If you do not agree to the terms of this Agreement, you must not use the Marketplace.

1. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding contract to use the Marketplace. You are responsible for ensuring that your use of the Marketplace complies with all applicable laws and regulations.

2. Accounts and account Creation

To use the Marketplace, you must have an EVM account(wallet). You are responsible for your own account and all activity that occurs under your account. You are responsible for keeping your account safe and secure. If you do not hold an active EVM wallet, this can be created in the marketplace. Again this will be a non custodial wallet and you are responsible for key security as well as safety.

3. Acceptable Use

You agree to use the Marketplace in accordance with this Agreement and all applicable laws and regulations. You will not use the Marketplace for any illegal or unauthorized purpose. You will not use the Marketplace to create, list, or sell any NFTs that are:

• Infringing on the intellectual property rights of others

• Hateful, discriminatory, or offensive

• Harmful to minors

• Illegal or fraudulent

4. Fees

The Marketplace charges fees for certain services, such as selling NFTs. You agree to pay all applicable fees in accordance with the Marketplace's fee schedule.

5. Intellectual Property

All intellectual property rights in and to the Marketplace, including its trademarks, copyrights, and trade secrets, are owned by Q Bazaar. You are granted a non-exclusive, non-transferable license to use the Marketplace for your personal, non-commercial use.

6. Disclaimer of Warranties

THE MARKETPLACE IS PROVIDED "AS IS" AND WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED. Q BAZAAR DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7. Limitation of Liability

Q BAZAAR IS NOT LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE MARKETPLACE, EVEN IF Q BAZAAR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8. Governing Law

This Agreement is governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

9. Entire Agreement

This Agreement constitutes the entire agreement between you and Q Bazaar regarding your use of the Marketplace and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.

10. Severability

If any provision of this Agreement is held to be invalid or unenforceable, such provision will be struck from this Agreement and the remaining provisions will remain in full force and effect.

11. Changes to the Terms of Service

Q Bazaar reserves the right to change this Agreement at any time. Any changes to this Agreement will be posted on the Marketplace website. Your continued use of the Marketplace after any changes to this Agreement have been posted constitutes your acceptance of such changes.
